A Guide: Navigating the Foreclosure Process

1. Missed Payments and Notice of Default

Foreclosure typically begins when a homeowner fails to make mortgage payments. After a few missed payments, the lender will issue a Notice of Default. This is a formal declaration from the lender that the borrower is behind on payments and it usually kicks off the formal foreclosure process.

2. Pre-Foreclosure Period

Once the Notice of Default is filed, the pre-foreclosure period begins. During this time, typically lasting from 30 to 120 days, the homeowner has the opportunity to pay off the debt or sell the property through a short sale to avoid full foreclosure. This period allows homeowners a chance to retain their property or mitigate financial damage.

3. Auction

If the debt is not settled during the pre-foreclosure period, the lender will schedule the home for a foreclosure auction. This public auction aims to recoup the unpaid mortgage balance. Buyers can bid on the property, often resulting in a sale for less than the market value.

4. Post-Foreclosure

If the property does not sell at auction, it becomes a real estate owned (REO) property, meaning the lender now owns it. Lenders typically try to sell these properties as quickly as possible, often at reduced prices, through real estate agents or public auctions.

5. Eviction

The final step in the foreclosure process is eviction. Once a new owner is in place, whether it’s a buyer from the auction or the lender as the new owner, the previous homeowner will need to vacate if they haven’t already done so. Evictions are handled through a legal process, ensuring that former homeowners leave the property within a specified time frame.
